Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MSS — Modern Site & Software platform ("MSS", "we", "our", or "us"), including our website at mss.al, any associated subdomains, APIs, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using MSS on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.

MSS provides a SaaS platform that allows users to:

• Create, publish, and manage websites using a visual drag-and-drop editor
• Deploy software applications including e-commerce stores, consulting sites, and property listing platforms
• Connect custom domains and subdomains with automatic SSL provisioning
• Access professionally designed templates
• Manage subscriptions, users, and platform access controls

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

To use most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with any third party
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities conducted under your account

You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that we believe, in our sole discretion, violate these Terms or are associated with fraudulent, illegal, or harmful activity.

You retain ownership of all content you create, upload, or publish through the Service ("User Content"). By submitting User Content, you grant MSS a non-exclusive, royalty-free, worldwide license to host, store, transmit, and display your content solely for the purpose of operating and providing the Service.

You agree not to use the Service to:

• Upload, publish, or distribute content that is illegal, defamatory, obscene, or infringes any third-party rights
• Engage in spamming, phishing, or other deceptive practices
• Distribute malware, viruses, or any other malicious code
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Violate any applicable laws or regulations, including data protection laws
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Collect or harvest user data without consent

MSS reserves the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

MSS offers subscription-based plans that provide access to different tiers of features. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase.

• Billing: Subscription fees are billed in advance on a monthly or annual basis depending on your plan selection
• Upgrades/Downgrades: Plan changes take effect at the start of the next billing cycle
• Taxes: You are responsible for any applicable taxes on your subscription fees
• Price Changes: We reserve the right to change subscription fees with 30 days advance notice
• Non-payment: Failure to pay may result in suspension or termination of your account

Refund policies are governed by our separate Refund Policy.

Either party may terminate the agreement at any time:

• By you: You may delete your account at any time through your account settings. Deletion is irreversible and all your data will be permanently removed.
• By us: We may suspend or terminate your access immediately, without prior notice or liability, if you breach these Terms, engage in fraudulent activities, or if we are required to do so by law.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MSS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall MSS's total liability to you exceed the amounts you have paid to MSS in the 12 months immediately preceding the event giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of Albania, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If such negotiation fails, the dispute shall be submitted to the courts of competent jurisdiction in Albania.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. We may also notify you via email or a prominent notice on our platform.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
